Daniel Vorcaro, the former controller of Banco Master, has been detained since March 2026. His defense has filed a complaint against Brazil with the Inter-American Commission on Human Rights, an Organization of American States body that promotes and protects human rights in the Americas. The lawyers say they are seeking to reverse his detention.

The defense alleges that Vorcaro’s rights have been violated, arguing that Brazil’s Supreme Federal Court has not ruled on a request for his release filed Sept. 18. The lawyers also say the country’s Prosecutor General’s Office has not filed charges against him and that his pretrial detention has not been reviewed every 90 days, as Brazilian law requires.

The complaint also addresses the disclosure of private conversations and personal information taken from Vorcaro’s cellphone, which was seized by the Federal Police. His lawyers contend that publishing private messages unrelated to the matters under investigation infringed on his privacy. The claims are allegations made by the defense; the commission’s involvement does not establish that rights violations occurred.

Individuals and organizations may petition the commission to report alleged human rights violations by an OAS member state. The body’s work includes reviewing individual petitions, monitoring human rights conditions in member states and addressing priority themes. It has emphasized protecting vulnerable populations and groups that have historically faced discrimination.

The commission can seek explanations from governments, recommend measures and request urgent protections for people at risk. It may also refer certain cases to the Inter-American Court of Human Rights. However, it cannot directly order a person’s release from detention. Vorcaro’s defense says his request for a review of his detention remains pending at the Supreme Federal Court. The Banco Master case, initially assigned to Justice André Mendonça, is now under the responsibility of the court’s president, Justice Edson Fachin.
